FoodLY will not collect any personal information about you except when specifically and knowingly provided by you. Examples of such information are name, shipping and billing addresses, phone number, email address, credit card information and customer preferences data.

Ordering a service or product

Purchasing any item via the FoodLY requires the submission of details relating to contacting you, credit card number and/or schedule. These kinds of personal information are used for billing purposes, to fulfill your orders, to communicate with you about your order and this Site, and for internal marketing purposes. If we encounter a problem when processing your order, we will use the personal information to contact you.

Information shared via email or comment forms

While FoodLY emphasizes personally connecting with you through phone or in person, sometimes, we may require to provide additional information via email to facilitate the process. Information shared in in-person sessions

Any personal information disclosed during any of the sessions, classes and workshops will not be used outside of communications with you, except in aggregated formats that provide you with anonymity. Such data contributes towards analyzing trends on a macro level.

Like most other websites, FoodLY uses cookie technology throughout this Site. We share the information with Asha INK, the parent company of FoodLY, for the same purposes as listed above. INK's follows the same stringent rules regarding disclosure and privacy of information.
We may transfer information about you if FoodLY or INK is acquired by or merged with another entity. In such cases, we will notify you before information about you is transferred and/or becomes subject to a different privacy policy.
We may share aggregate or summary information regarding our customers with partners, advertisers or other third parties. This data will never identify you personally.
We may share information with companies that provide support services to us (such as a printer, mailing house, fulfillment company or web host) or that help us market our products and services. This information may also be shared with marketers whose products or services we feel may be of interest to you. These companies may need information about you in order to perform their functions. These companies are not authorized to use any personal information we share with them about you for any other purpose.
We will use your personal information to communicate with you about your orders and deliveries, and we may send you a confirmation email when you register/place an order with us.

This Agreement (the "Agreement") is an agreement between you and FoodLY and Asha INK, that states the legally binding terms and conditions for your use of the site ("www.food-ly.com") and receive services mentioned thereof, which includes processing and delivery of service and product orders (the "FoodLY Service").

By using the Site in any manner, including but not limited to visiting or browsing the Site, you (the "user" or "you") agree to be bound by this Agreement, including any other other terms and conditions listed from time-to-time and appropriately noted across the site. This Agreement applies to all users of the Site, including without limitation users who are vendors, customers, merchants, contributors of content, information and other materials or services on the Site.

FoodLY reserves the right to modify and update these terms at any time. Any changes made will be duly posted here. FoodLY's operations are grounded in providing ideas and inspirations to lead a wholesome and unprocessed eating style.

For the purpose of the services, unprocessed is defined as chemically altered and boxed items, food products that have added preservatives or chemical derivatives of plant products, synthetically manufactured compounds with the exception of certain common pantry items including baking soda, baking powder, organic corn starch, all grain and nut flours.

In as much as this is a service customized to your preferences, with mutual agreement, FoodLY may provide services that incorporate items otherwise violating the definitions set forth above. Under such circumstances, FoodLY is released of all obligation to hold to the pledge and also assumes no responsibility for any consequences.

Limited Liability

FoodLY does not have or claim to possess any medical certification, including nutritional understanding. FoodLY services are based on the philosophy of culminated culinary wisdom rather than scientific approaches. It focuses on a healthful lifestyle by eating wholesome food, sourced and prepared naturally and consumed in moderation.

Consequently, FoodLY bears no responsibility for assessing your medical needs and cannot guarantee that recommendations will be aligned to them. By using any of its products and services, you agree that you have understood all the risks of engaging in such a service with or without medical consultation. You agree that you are responsible for any and all consequences of using the service and in so far as that holds, you waive any liability recourse measures against FoodLY, its team and Asha INK . By using this service you agree that you hold no liability to FoodLY with regards to its content, text, photographs, graphics, illustrations,information. By using these services, you release the FoodLY team and Asha INK of any liability during your engagement with the services and in the future. You use the FoodLY services and any service rendered by Asha at your own risk.

ACCESS TO SERVICES

Jurisdiction

While the services of Foodly are available globally, the service is incorporated in Brooklyn, New Yosk and, as such, is governed by the laws of New York state with United States Federal oversight. Please note that use of this service, in your country, may or may not be compliant with local laws. The onus of verifying its compliance lies on you as the "User".

Eligibility for Use

FoodLY 's services and products may only be used by individuals, who are 18 years and older who are able to enter into legally binding contracts under applicable law. By browsing this site and accessing its services, you pledge and warrant that you are at least 18 years old and capable of willfully and independently making decisions (non-insanity clause). You warrant that all information you submit is truthful and accurate.

Individuals under the age of 18 must at all times use the services only under supervision of a legal guardian. In such cases, the adult holds the binding responsibility under this Agreement.

Account Information Accuracy

All account information must be maintained up-to-date and accurate at all times, including a valid email address. To purchase products and services on FoodLY you must provide and maintain valid payment information such as valid credit card information. FoodLY assumes no responsibility for failed deliveries due to errors in information provided at checkout.

In the event of failure to provide correct payment information, you are liable to pay a penalty up to 10 times the cart value of the product in question.

Agency and Liability Transfer

You may not transfer your contract with FoodLY to another or choose an agent to represent you in any transaction with FoodLY.

If you are a business partner, you personally guarantee that you have the authority to bind the entity to this Agreement. In the event of acquisition, third party involvement, or any other change of authorizing signatory, pending transactions and contracts will be carried over automatically to the new authorizing entity. Renegotiations will occur only at the end of the current contract term.

Sole Discretion

FoodLY may, at its sole discretion, refuse to offer access to or use of the Site, and/or any services on this site, to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Site is revoked in such jurisdictions.

PURCHASE AGREEMENTS

All purchases are binding and final. Unless otherwise specified, purchases are non-transferrable and non-refundable. The buyer is obligated to deliver appropriate payment for items purchased, unless there is an exceptional circumstance. Failure to do so may result in penalties up to 10x the cart price of the order.

Fees and charges

FoodLY charges fee for all of its products and services. Where applicable pricing is made available on this site. For custom packages, classes and sessions, price quotes will be sent and delivery made only upon written consent from you with regards to acceptance of the fee. Such consent will be documented via email and will serve as your acceptance in to a legal binding contract for the transaction of said services.

FoodLY reserves the right to change the charges and applicable fees at will. Such changes are effective immediately.

In the event of launching a new service, fees for that service are effective at launch.

Unless otherwise stated, all fees are quoted in US Dollars (USD). You are liable to pay the applicable taxes for all transactions. Per NY state law, a tax of 8.875% will be added to all purchases.

COPYRIGHT AND OWNERSHIP

All content on this site, including text, graphics, illustrations, photographs, design, workflow, and interfaces, software and interactions thereof, is copyrighted and licensed to FoodLY and Asha INK.

No part of this site may be reproduced unless as authorized.

Consent is granted to view, electronically copy, and print in hard copy portions of this Site for the sole purpose of engaging with FoodLY in purchasing its services.
Any other use of materials on this Site, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of FoodLY is strictly prohibited and violators will be prosecuted aggressively.
For any product purchases, you acknowledge that FoodLY and/or third-party content providers retain the full rights and ownership to the content and you do not acquire ownership by downloading or purchasing copyrighted material.

FoodLY services are based on the Freedom of Expression Act. In so far as the act allows, information, opinions and views are that of FoodLY and may or may not have any scientific evidence supporting the same.

You agree that FoodLY shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services .

In cases where FoodLY refers to or links to external resources, it cannot guarantee the veracity of the same or their availability at all times. FoodLY does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources.

PRIVACY

FoodLY is bound by the terms of the Privacy Policy stated on this site. Except as provided within said policy, your personal information will not be sold or transferred to third parties without your explicit consent.

AMENDMENTS
